2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 420 and 406 of the Indian Penal Code .

3. As per the prosecution case, petitioner demanded Rs. 6 lakhs from the complainant with the assurance to return the same within one year in installment of Rs. 50,000/- per month and accordingly complainant gave Rs. 1.5 lakh to the petitioner but he refused to return the same .

4. Learned counsel for the petitioner submits that the entire case of the complainant is false and fabricated. As a matter of fact, petitioner has a grocery shop and the complainant

No.46046 of 2024(2) dt.06-08-2024 2/2 had taken goods from the shop of petitioner and when petitioner asked for money , complainant refused to give money and also lodged the present false and fabricated case against the petitioner. There is no chit of paper in support of the allegation and as such no case under Section 420 of IPC is made out against the petitioner. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned JM 1st Class Barh in connection with Complaint case No. 552 (C) of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
