The petitioner is in custody since 29.01.2018 in connection with Shakurabad P.S. Case No. 138 of 2017 for the offence registered under Sections 302/201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the present case was instituted after almost six months of the alleged occurrence. It is further submitted that the first information report was lodged on 6.12.2017 whereas the alleged occurrence is of 26.06.2017, for which, no plausible explanation has been offered by the informant for delay in lodging the present first information report. It is further submitted that the petitioner has been taken

Patna High Court Cr.Misc. No.19682 of 2018 (3) dt.26-04-2018 into custody on mere suspicion.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM-cumSub Judge-1, Jehanabad in connection with Sakurabad P.S. Case No. 138 of 2017.
