The petitioners apprehend their arrest in a case under Section 307 and other sections of the Indian Penal Code. The petitioners are alleged to have assaulted a lady with fists and slaps.

It is submitted that the injuries are simple in nature and land of petitioners is situated adjacent to the land of informant.

It appears that the petitioners are alleged to have assaulted with fists and slaps. The doctor found injuries on nose, nostril and mouth, of course, the injuries are simple in nature. Considering the facts aforesaid and the nature of

Patna High Court Cr.Misc. No.25433 of 2015 (2) dt.14-07-2015 2/2 allegations made against the petitioners, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.

If so advised the petitioners may surrender before the court below, i.e., learned Chief Judicial Magistrate, Siwan, and pray for regular bail. The court below shall consider the prayer for regular bail of the petitioners on merit without being prejudiced by this order.
