JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 08-12-2016 Heard Dr. Amrendra Kumar for the petitioner and the APP for the State.

The petitioner prays for bail in Barachatti P.S. Case No. 242 of 2016 registered under sections 272 & 273 IPC including section 47(a) of the Bihar Excise (Amendment) Act, 2016. The informant has alleged that from the car occupied by the petitioner as well as the driver whereof, 72 litres of Indiamade foreign liquor was recovered. It is stated that the petitioner is in custody since 10.07.2016 having no criminal antecedents of like nature. Coaccused Munna Kumar has since been released on bail by this Court vide order dated 06.10.2016 passed in Cr. Misc. No. 41889 of 2016.

In the circumstances above, let the petitioner above

Patna High Court Cr.Misc. No.47796 of 2016 (3) dt.08-12-2016 2/2 named be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate, Sherghati, Gaya in Barachatti P.S. Case No. 242 of 2016 (G. R. No. 1108/2016) on condition that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge, the petitioner shall appear in person each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall have liberty to cancel his bail bonds and secure his arrest in accordance with law.
