JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 08.01.2015 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State assisted by learned counsel for the informant.

Petitioners apprehend their arrest in connection with Bihta P. S. case no. 165/2014 registered under section 307 and other allied sections of the IPC.

Admittedly, there is case and counter case between the parties and there is no allegation of assault against these petitioners. It is only stated in the fardbeyan of the informant that the petitioners and two others caught hand of the informant with bad intention and except the aforesaid allegation, there appears to be nothing against these petitioners.

Accordingly, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the

Patna High Court Cr.Misc. No.211 of 2015 (2) dt.08-01-2015 petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Danapur in Bihta P. S. case no. 165/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
