The petitioner, who is in custody, seeks bail in connection with Darbhanga G.R.P. P.S.Case No. 87 of 2016 registered under Sections 379, 411 and 414/34 of the Indian Penal Code.
Allegation, in brief, is that the informant was on a railway ticket counter and on that moment his mobile was stolen and one accused Md. Nehal was apprehended along with said mobile, on interrogation, he disclosed in his statement that there were his two associates including the petitioner and it is alleged that, two old mobiles were recovered from the possession of the petitioner.
Learned counsel for the petitioner submitted that
Patna High Court Cr.Misc. No.53750 of 2016 (2) dt.14-12-2016 2/2 there is no recovery of any stolen mobile from the possession of the petitioner rather recovery is specific against Md. Nehal and the petitioner has got no criminal antecedent.
Considering the aforesaid facts and circumstances particularly, except the confessional statement of accused Md. Nehal about the petitioner being his associate, no recovery of any alleged stolen article has been made from the petitioner, so he is directed to be released on bail upon furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. (Railway) Samastipur in connection with Darbhanga G.R.P. P.S. Case No. 87 of 2016. (Arun Kumar, J) Sujit/- U
