JUSTICE BIRENDRA KUMAR ORAL ORDER 28-03-2017 Heard the learned counsel for the petitioners and the State.

This is a petition for grant of regular bail for offence under Section 366A of the Indian Penal Code. The first information report was lodged with allegation of kidnapping of Pravesh Baitha, a minor boy. The victim boy in his statement under Section 164 of the Criminal Procedure Code alleged that petitioners and others took him in their lap and took to Motihari and left on railway station where the father of the victim came and took him to the house.

Submission of the petitioners is that there is no allegation, at all, disclosing a non-bailable offence. Due to village politics the police case has been lodged.

Patna High Court Cr.Misc. No.7707 of 2017 (4) dt.28-03-2017 2/2 Considering the aforesaid fact, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Jogapatti P.S. Case No. 345 of 2016 to the satisfaction of the Chief Judicial Magistrate, West Champaran at Bettiah, (in Cr. Misc. No. 7707 of 2017) and to the satisfaction of Additional Chief Judicial Magistrate, II, West Champaran at Bettiah, (in Cr. Misc. No. 11255 of 2017) or successor Court with the condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the Court below shall be at liberty to cancel the bail bond(s) of the petitioners.
