1. Heard learned counsel for the parties.

2. The petitioners have preferred this application for grant of anticipatory bail apprehending their arrest in connection with Sabour P.S. Case no.88 of 2025, registered under sections 126(2), 115(2), 109, 351(2), 352, and 3(5) of the Bhartiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the informant states that over dispute between the neighbours, the three accused persons including the two petitioners herein came variously armed and started to hurl abuses. It is further stated that Dhananjay Tanti assaulted the informant on his head with an

Patna High Court CR. MISC. No.43627 of 2025(2) dt.23-07-2025 2/3 iron rod as a result of which he fell down. Mangal Tanti assaulted the informant on his back with a lathi while Ramdhani Tanti instigated the other co-accused to assault him.

4. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the case over a trivial dispute between the neighbours. The allegation of assault on the head with an iron rod is not against these petitioners but on co-accused Dhananjay Tanti. The petitioners have no criminal antecedent and undertake to cooperate in the investigation/trial.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioners in the F.I.R., the allegation of assault with an iron rod on the head of the informant not being on these petitioners but on co-accused Dhananjay Tanti together with the petitioners not having any criminal antecedent, it is directed that both the petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Sabour P.S. Case no.88 of 2025 on each of
