Petitioner, already in custody, seeks bail in connection with Raj Nagar PS Case No.144 of 2017, registered under Sections 302/201/34 of the Indian Penal Code. Submission is that the petitioner is not named in the FIR and has been apprehended only after recovery of the mobile of the deceased from his possession; whereas the learned counsel for the State submits that the informant was not the eye witness, he raised only suspicion against the FIR named accused persons, however, the involvement of the petitioner was found because after death of the deceased, his mobile was recovered from him and there was no explanation that how the petitioner was in possession of the mobile of the deceased. It appears that

Patna High Court Cr.Misc. No.13304 of 2018(4) dt.26-04-2018 2/2 just after murder of the deceased, his mobile was being used by the petitioner and the same was recovered from his possession. Having considered the aforesaid facts and circumstances, presently the prayer of bail of the petitioner is rejected in connection with Raj Nagar PS Case No.144 of 2017, pending in the court of learned CJM, Madhubani.
