2. The petitioner seeks bail in connection with Hisua P.S. Case No. 68 of 2025 registered for the offence under Sections 303(2) of BNS

3. As per the prosecution case, FIR has been lodged against unknown accused person with an allegation that he has stole the motorcycle of the informant bearing registration no. BR-27R-2418.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been implicated in the present case. He further submits that the alleged motorcycle is not recovered from the possession of the petitioner. He name has been figured only and only due to

Patna High Court CR. MISC. No.38513 of 2025(2) dt.18-06-2025 2/2 suspicion. Moreover no TIP has been conducted as yet. Petitioner is in custody since 02.03.2025 and remanded in this case on 18.03.2025. He possesses one criminal antecedent.

5. Learned APP appearing for the state opposes the prayer for bail of the petitioner.

6. From perusal of the FIR and the impugned dated 20.05.2025, it appears that the alleged motorcycle bearing registration no. BR-27R-2418 has not been recovered from the possession of the petitioner nor TIP has been conducted as yet. Moreover, petitioner is not named in the FIR. Considering all aspect of the matter and submissions made on behalf of the learned counsel for the petitioner, let the above name petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of like amount each to the satisfaction of learned CJM Nawada in connection with P.S. Case No. 68 of 2025.
