2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Halsi P.S. Case No. 254 of 2024 instituted for the offence under Sections 115, 126(2), 75, 303(2), 308(2), 351(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. The case of the prosecution is that the informant
Patna High Court CR. MISC. No.39210 of 2025(2) dt.01-07-2025 2/3 was going with her daughter-in-law for working in the fields. It is further alleged that the accused persons were there. In the way Prem Shankar Singh and Uma Shankar Singh started abusing the informant and her daughter-in-law, knocked down both the ladies and it is further alleged that three persons were there near the canal being armed with weapon. On the order of Prem Shankar Singh, all the accused persons attempted to disrobe the informant. The ladies started crying, on this passers-by arrived there and saved them.
4. Learned counsel appearing on behalf of the petitioners has submitted that there is also counter version of this case. It has been submitted that prior to the institution of this case, the other side has filed a case against the informant party wherein it has been alleged that informant party has assaulted and demanded rangdaari. Learned counsel for the petitioners has also submitted that the petitioners are having criminal antecedent which is disclosed in para-3 of the bail petition and all these cases are between the same parties as there is alleged dispute between the parties.
5. In contra, learned APP appearing for the State has vehemently opposed the prayer for bail of the petitioners.
6. Having heard learned counsel for the parties and in
Patna High Court CR. MISC. No.39210 of 2025(2) dt.01-07-2025 3/3 the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Halsi P.S. Case no. 254 of 2024, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate 1st Class, Lakhisarai subject to the conditions as laid down under section 438(2) of the Cr.P.C.
