2. The petitioner apprehends his arrest in connection with Mohania P.S. Case No. 568/2021 registered for the offence punishable under Sections 30(a) and 41(1) of the Excise Act. Later on, the case was found for the offences under Sections 8(c)/21(c)/22 & 29 of the NDPS Act.

3. The S.H.O. Mohania police station and the Investigating Officer of the case have appeared.

4. They have submitted that the petitioner has not produced any document to show that he had sold the vehicle in question and they submit that it is the petitioner who has made a statement that he has sold the vehicle but no proof of any monetary transaction between the purchasers and the petitioner has

5. In these circumstances, considering the recovery of 2250 bottles each containing 100 ml of Phensedyl Chloropheniramine Maleate & Codemine Phosphate cough linetas syrup from the vehicle, this application is dismissed.

6. The petitioner is directed to surrender and pray for regular bail within two weeks failing which the police shall arrest the petitioner.
