2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

3. Learned counsel appearing on behalf of the petitioner submits that the petitioner is a person with clean antecedents and the dispute is matrimonial. The petitioner has been falsely implicated in the instant case, being the husband. It is further submitted that the petitioner was willing to keep the opposite party no. 2 and the child with honour and dignity, as

It is submitted that the petitioner, in compliance with the order dated 27.08.2025, had gone to the house of opposite party no. 2 to fetch her back to the matrimonial home along with the child but the opposite party no. 2 refused to accompany the petitioner.

4. Learned counsel appearing on behalf of the opposite party no. 2 fairly submits that the petitioner had come to the house of the opposite party no. 2 to fetch her back to her matrimonial home along with the child, but the opposite party no. 2 does not intend to resume her conjugal rights.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the opposite party no. 2, let the petitioner abovenamed, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Complaint Case No. 281C of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

7. Accordingly, the instant anticipatory bail application stands allowed.
