JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 19-09-2016 In view of Section 14A of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015, the instant application under Section 439 of the Code of Criminal Procedure for the offence punishable under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 is not maintainable.
At this stage, Mr. Mukesh Kumar Rana, learned counsel for the petitioner seeks leave to withdraw the present application in order to file an appropriate appeal before this Court. Leave is granted.
The application is disposed of as withdrawn.
In case the petitioner files a photo copy of the FIR and the impugned order passed by the 1st Additional Sessions Judge, Araria, the Registry is directed to return him the certified copy of
Patna High Court Cr.Misc. No.39824 of 2016 (2) dt.19-09-2016 2/2 the FIR and the impugned order after retaining the photo copy of those documents on record.
