JUSTICE BIRENDRA KUMAR ORAL ORDER 10-04-2017 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners are languishing in custody for offences punishable under Sections 25(1-B)a/26/35 of the Arms Act.

From possession of petitioner Azad Akhtar a gun was recovered and from the possession of petitioner Sami Akhtar nine cartridges were recovered.

Submission is that petitioners are in custody since 25.09.2016 and have got no such criminal antecedent and investigation is complete now.

Considering the aforesaid circumstances, let

Patna High Court Cr.Misc. No.4136 of 2017 (4) dt.10-04-2017 2/2 petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran/Successor Court, in connection with Motihari Town P.S. Case No. 603 of 2016, with condition that petitioners shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioners in this case.
