This is an application for bail in connection with Tarapur P.S.Case No. 73 of 2016 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
It has been submitted on behalf of the petitioner that at best only allegation against the petitioner is that accused persons who had fired at the deceased had come out from the house of the petitioner and the petitioner is in custody since 13.7.2016 and has no criminal antecedent.
Heard learned APP also.
Learned APP has opposed the prayer for bail stating that the petitioner appears to be the main conspirator in this case.

No.590 of 2017 (3) dt.02-02-2017 2/2 Having heard both sides and considering the fact that there is no allegation of assault against the petitioner and there is suspicion against him, let the petitioner, Md. Imtiyaz @ Md. Imtiyaz Mansuri, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri S.K.Singh, Judicial Magistrate, 1st Class, Munger, in connection with Tarapur P.S.Case No. 73 of 2016, subject to the conditions that one of the bailors should be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further the petitioner will co-operate in the trial and make himself available before the court on each and every date fixed and in the event of failure on his part to appear before the court on two consecutive dates, except showing some genuine ground, his bail bond shall be liable to be cancelled.
