2. Petitioners seek regular bail in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 109, 103(1), 352 and 351(2) of the BNS.

3. The prosecution case, in brief, is that on 25.11.2024 at about 07:00 am, 7 named accused persons including this petitioner along with 4-5 unknown persons having lathi, danda, iron rod, spade, khanti and arms in their hands attacked informant and her family members as a result of which five persons sustained injuries and during course of treatment

Patna High Court CR. MISC. No.42628 of 2025(3) dt.21-11-2025 2/2 injured Anirudh died.

Learned counsel for the petitioners submits that from a bare perusal of the FIR it is apparent that allegation of assault is general and omnibus in nature against 7 named accused and 4-5 unknown persons. No specific overt act has been alleged against this petitioner. Petitioners claim clean antecedent. Petitioner no.1 & 2 are under custody since 19.03.2025 and petitioner no.2 is under custody since 29.03.2025.

5. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application.

6. Considering the nature of allegation, clean antecedent and period of custody, the bail application is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Sabour P. S. Case No. 405 of 2024.
