Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Earlier the prayer for bail of the petitioner was rejected by a co-ordinate Bench of this court but again petitioner seeks bail on the ground that in course of trial informant failed to identify the petitioner and apart from this he admitted that he had not seen as to whether firing of the petitioner hit the deceased or not.

No.38795 of 2016 (4) dt.24-11-2016 2/2 It would appear from perusal of Annexure-4 to the supplementary affidavit that defence evidence has already been closed and the case is pending for argument and the aforesaid fact goes to show that the present case is on the verge of conclusion. Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Sessions Trial No. 72 of 2015 arising out of Dhansoin P.S. Case No. 88 of 2014 pending in the court of Additional Sessions JudgeV, Buxar is again rejected. However, the learned trial court is directed to dispose of Sessions Trial No. 72 of 2015 within a month from the date of receipt/production of copy of this order.
