2. The petitioner is in custody since 12.09.2018 in connection with Sessions Trial No. 85 of 2019 arising out of Forbesganj P.S. Case No. 686 of 2018 for the offences alleged under Sections 399 and 402 of the Indian Penal Code and Sections 25(1b)a, 26 and 35 of the Arms Act.

3. It is submitted that the petitioner has been falsely implicated in connection with recovery of one live cartridge from his possession. The petitioner's case stands on better footing than coaccused Sakaldev Paswan from whose possession one loaded country made pistol was recovered, has been granted bail by a coordinate Bench of this Court vide order 10.4.2019 passed in Cr. Misc. No. 23005 of 2019.

4. Be that as it may, and having regard to the period of custody already spent by the petitioner, let him be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Additional District & Sessions Judge-V, Araria, in connection with Sessions Trial No. 85

Patna High Court CR. MISC. No.36499 of 2019(2) dt.13-06-2019 2/2 of 2019 arising out of Forbesganj P.S. Case No. 686 of 2018, on the following conditions:- (i) That one of the bailors shall be a close relative of the petitioner.

(ii) That the petitioner shall not indulge in any similar offence till conclusion of the trial.

(iii) That the petitioner shall remain physically present in Court on each and every date, and in the event of failure on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court concerned. (iv) That the petitioner shall cooperate with the investigation, if not already concluded, and make herself available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail.
