JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 24-02-2021 Heard learned Senior Counsel for the petitioner and Mr. Md. Fahimuddin, learned APP for the State. This is the second attempt of the petitioner to obtain regular bail in connection with Navinagar P.S. Case No. 49 of 2012 registered for the offences punishable under Sections 302 and 201 of the Indian Penal Code.
A report as contained in letter no. 08 dated 09.02.2021 has been received from the learned trial court but according to this communication, the trial is likely to be concluded within a period of four months.
In the aforesaid view of the matter, this Court is not inclined to grant bail to the petitioner.
Let the trial court proceed with the trial on day-to-day basis and conclude the same within the stated period. If any
Patna High Court CR. MISC. No.1898 of 2021(3) dt.24-02-2021 2/2 official witness such as I.O. or the doctor is not appearing, the Superintendent of Police, Aurangabad shall ensure that those official witnesses must appear in the case on the next date. If the trial remains unconcluded for a period of four months for no reasons attributable to the petitioner, the petitioner may renew his prayer for bail.
