JUSTICE RAVI RANJAN ORAL ORDER 25-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offences punishable under Sections 3 / 4 / 5 of Immoral Traffic Act . As per allegation petitioner was involved in flesh trade and induced ladies including one Supriya Khatoon. It is contended on behalf of petitioner that during the course of investigation said Supriya Khatoon has stated that the petitioner has allured her and brought her in the concerned room for sexual relation with customers. However, it is contended that in the statement under Section 164 of the Code of Criminal Procedure, she has stated that the petitioner has not misbehaved with her though she had taken his name and stated that upon his call, she went to that house which was raided by the police. Patna High Court Cr.Misc. No.45627 of 2016 (2) dt.25-10-2016 2/2 urged that petitioner is in custody since 27.06.2016. Be that as it may, considering the facts and circumstances of the case, the above named petitioner is directed to be released on bail, after completion of eight months in custody from the date of his judicial custody, on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Kumari Jyotsna Judicial Magistrate 1st Class, Patna in Ram Krishna Nagar P.S. Case No. 130/2016 with a further condition that one of the bailors of the petitioner must be his father.

It is made clear that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
