The petitioner seeks bail in connection with Barachatti P.S. Case No. 528 of 2013, registered under Sections 147, 148, 149, 302, 326, 307, 379, 435 and 120-B of the Indian Penal Code, Section 27 of Arms Act, Section 17 C.L.A. Act and Section 39, 10, 16, 13, 20, 21 and 38 of U.A.P. Act. Learned counsel for the petitioner submits that, in fact, petitioner was allowed bail vide Criminal Miscellaneous No. 43560 of 2014, which was disposed of along with Criminal Miscellaneous No.23471 of 2014 and Criminal Miscellaneous No.28021 of 2014 on 09.01.2015, but at the time of allowing the prayer for bail of the petitioner in Criminal Miscellaneous No. 43560 of 2014, inadvertently it was detailed that petitioner had fair antecedent, but at the time of furnishing of bail bonds, the
Patna High Court Cr.Misc. No.18059 of 2017 (3) dt.11-05-2017 2/2 petitioner disclosed that he is accused in four other cases and due to that reasons, the bail bonds of petitioner could not be accepted as detailed in para-03 of the petition, but now he has been released on bail in all four cases. Further submission is that in the present case, the petitioner is in custody since 28.11.2013. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Gaya, in connection with Barachatti P.S. Case No.
528 of 2013 subject to the conditions (i) That one of the bailor will be a close relative of the petitioner, who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will undertake to furnish information to the Court about any change in address of the petitioner. (ii) That the petitioner will be well represented on each date if he fail to do so on two consecutive dates, their bail will be liable to be cancelled.
