JUSTICE ARUN KUMAR ORAL ORDER 16-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 18.12.2017, seeks bail in Ramnagar PS Case No. 454 of 2017 registered under Sections 302, 304(B)/34 of the IPC.

The allegation in brief is that for realizing further demand of dowry the petitioner along with the others killed his wife by setting fire over her body.

Learned Counsel for the petitioner submits that it was an accidental burn injury, the petitioner also got burn injury in both hands while trying to extinguish fire, both were treated at Primary Health Center and thereafter brought her to PMCH where she died, it was petitioner's brother who brought them for treatment, the FIR itself reveals that the informant received information on 15.10.2017 itself but the FIR was lodged after a delay of seven days for some extraneous reasons and the petitioner surrendered on 18.12.2017.

Having considered the said facts and circumstances, the petitioner, namely, Ekram Ansari is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Bagaha District West Champaran in connection with Ramnagar PS Case No. 454 of 2017. (Arun Kumar, J) Snkumar/- U T
