JUSTICE SANJAY PRIYA ORAL ORDER 13-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Section 394 of the Indian Penal Code. Subsequently, Section 395 of the Indian Penal Code was added. It has been submitted that the petitioner is not named in the First Information Report. The petitioner is in custody since 17.12.2015, but no Test Identification Parade has been done till date. The petitioner was remanded in this case while he was in custody I n Bakhtiyarpur P.S. Case No. 259 of 2015. From paragraph-3 of the bail petition, it appears that altogether 14 cases are pending against the petitioner, but in all these cases, he has been granted bail.

Considering that since the petitioner is neither named

Patna High Court Cr.Misc. No.52516 of 2016 (3) dt.13-01-2017 2/2 in the First Information Report nor Test Identification Parade has been held and he is in custody since 17.12.2015, let him be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. VIth, Barh, Distt. Patna, in connection with Sessions Trial No. 352 of 2016 arising out of Bakhtiyarpur P.S.
