Petitioner is a labour union of erstwhile Motihari Sugar Mill. The management of the Mill did not pay dues of the workers who had retired from service. In this background, writ petition has been filed seeking a direction upon the respondent State not to allow the Sugar Mill to dispose of properties without making payment of the dues of the workers as well as the agriculturists

Patna High Court CWJC No.22367 of 2011 (2) dt.01-10-2015 2/2 that supplied cane to the Sugar Mill while in production. Counsel for the State draws attention of the Court to the averments made in paragraphs 5 to 9 in order to submit that certificate proceedings have already been instituted and the Mill has already been restrained from alienating the land. More than 34 lacs of rupees have already been collected and distributed among the workers of the Mill.

This appears the reason for the petitioner in not pursuing the present proceeding.

The writ application is dismissed.
