JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-05-2017 The petitioner has renewed his prayer for bail in a case registered for the offences punishable under Sections 20, 22, 23 of the Narcotic Drugs & Psychotropic Substances Act. The prosecution case is that on the information that co-accused Bajrangi Rai deals in trade of ganja and from whom the petitioner has brought ganja from Nepal, the raid was conducted and from the possession of the petitioner and coaccused Bajrangi Rai 8.8 Kg. of ganja was recovered. It is submitted by learned counsel for the petitioner that petitioner is languishing in custody since 17.06.2016. The recovery is between small and commercial quantity. Patna High Court Cr.Misc. No.6174 of 2017 (2) dt.10-05-2017 2/2 accused Bajrangi Rai has been granted bail by a coordinate Bench of this Court vide order dated 03.05.2017 passed in Cr. Misc. No. 40045 of 2016.
Considering the recovery between small and commercial quantity, petitioner having no criminal antecedent and co-accused has been granted bail by a coordinate Bench of this Court, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional District Judge-cum-Special Judge, Sitamarhi in connection with Parihar P.S. Case No. 83 of 2016. Learned Court below will be at liberty to positively cancel the bail bonds of the petitioner, if the petitioner defaults for two consecutive occasions during trial or indulge in similar nature of offence.
