JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-04-2017 At the very outset, it is submitted on behalf of the petitioners that during the pendency of this petition, petitioner no. 9 , Ranjan Paswan, was arrested and as such, he seeks permission to withdraw this petition as against petitioner no. 9. Accordingly, this petition is dismissed as withdrawn as against petitioner no. 9.
This is an application for grant of anticipatory bail for offences punishable under Sections 147, 148, 149, 341, 323, 354B, 379, 504 and 506 of the Indian Penal Code and 27 of the Arms Act.
Allegation, as per F.I.R, against the petitioners is
Patna High Court Cr.Misc. No.16751 of 2017 (2) dt.13-04-2017 2/3 general in nature. No specific allegation is alleged against the petitioners though F.I.R. has been lodged under Sections 354 B and 379 and other allied Sections of the Indian Penal Code and Section 27 of the Arms Act.
Heard learned counsel for the petitioners.
It has been submitted that police after investigation submitted chargesheet under Sections 341, 323, 379, 504 and 506/34 of the Indian Penal Code and as a matter of fact, litigation is going on between the parties and due to that they have been implicated in this case.
Heard learned A.P.P. also.
Having heard both sides, in view of the facts and circumstances of the case and there is general allegation against the petitioners , let above named petitioners no. 1 to 8, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal, in connection with Kurtha P.S. Case no. 81 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and also subject to the conditions that (1) bailors should be local having sufficient immovable property within the jurisdiction of the
