JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-08-2022 After some arguments, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to challenge the order dated 14.05.2019, passed by the Circle Officer, Sheikhpura in Encroachment case no. 10 of 2003-04/ Encroachment case no. 02 of 2019-20, by filing appropriate appeal. Liberty so sought, is granted.

Considering the fact that the petitioner has also preferred a Title Suit with regard to the land in question, status quo, existing as on today, shall be maintained, in case, appropriate appeal is filed before the Appellate Authority within a period of four weeks from today. It is needless to state that the appeal of the petitioner, to be filed by the petitioner before the

Patna High Court CWJC No.10519 of 2022(2) dt.11-08-2022 2/2 Appellate Authority shall be decided on merits, without the Appellate Authority being impeded by the issue of limitation, in case the same is filed within a period of four weeks from today.
