The petitioner seeks bail in connection with K. Hat (Maranga) P.S Case No. 476 of 2016 registered for the offence punishable under Section 414 of the Indian Penal Code. Allegedly, the petitioner fled away after leaving the motorcycle, but later on he was apprehended with key of that motorcycle and he confessed that motorcycle was stolen from Islampur, West Bengal.
Submission is of false implication and that the petitioner has been made victim of the circumstances, nothing has been recovered from possession of the petitioner, the petitioner has got no concern with the said motorcycle and without any fault
Patna High Court Cr.Misc. No.12732 of 2017 (2) dt.12-04-2017 2/2 he is suffering in custody since 16.12.2016.
Learned A.P.P on the other hand submits that the petitioner has got criminal antecedent and he is involved in several cases.
In the facts and circumstances stated above, at present I am not inclined to enlarge the petitioner on bail and accordingly, his such prayer stands rejected in connection with K. Hat (Maranga) P.S. Case No. 476 of 2016, pending in the court of learned Chief Judicial Magistrate, Purnea.
However, the petitioner may renew his prayer for bail after remaining six months in custody.
