ANJANA MISHRA ORAL ORDER 11-01-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner seeks the benefit of anticipatory bail in connection with Madhubani Town P.S. Case No.84 of 2016 for allegedly having committed the offence under Sections 406, 419 and 420 of the Indian Penal Code, which is pending in the court of the learned Chief Judicial Magistrate, Madhubani. Diary in the present case was called for, which has since been received.

A perusal of the diary reveals that the petitioner has already been taken into custody and after availing the privilege of Section 41A of the Cr.P.C., the petitioner was set free by the local police.

No.47075 of 2016 (3) dt.11-01-2017 2/2 Since the petitioner has already given an undertaking that he shall co-operate and appear at all material times, it will be open to the petitioner to approach the Court for regular bail after appearing, in accordance with the provisions of the Cr.P.C. as enshrined in Section 41A of the Cr.P.C.

The order passed by this Court in the present application shall not prejudice the case of the present petitioner. If an application for regular bail is filed, the same may be disposed of expeditiously, preferably on the same day. The application, thus, stands disposed of.
