JUSTICE NAVANITI PRASAD SINGH) Date: 08-04-2015 Having heard learned counsel for the appellants, learned counsel for the Bihar Public Service Commission (in short B.P.S.C.) and learned counsel for the State, we are satisfied that nothing remains of the litigation which resulted in judgment by this Court, the
Patna High Court LPA No.1334 of 2000 dt.08-04-2015 - 2 - review of which was sought but refused against which this Letters Patent Appeal has been filed. The reason is that the Apex Court in the case of Bihar Public Service Commission and another Vs. State of Bihar and others since reported in (1997) 3 Supreme Court Cases 198 = 1997 (2) PLJR 10 (SC) cleared the field by accepting the report of the Biswas Committee and directing that all the examinations that were conducted by the Bihar State Subordinate Services Selection Board in the period concerned be scrapped. It agreed with the order of the High Court that consequent to the abolition of the Bihar State Subordinate Services Selection Board the work has been entrusted to the B.P.S.C. and the B.P.S.C. would take fresh steps for recruitment.
In that view of the matter, nothing is left in the review proceedings or in the writ proceedings for that matter. This appeal is, therefore, dismissed.
