JUSTICE ANIL KUMAR SINHA ORAL ORDER 30-08-2019 The petitioner apprehends his arrest in connection with Nautan P. S. Case No. 183 of 2018 registered under Sections 363, 364/34 and 302 of the Indian Penal Code. Allegation against the petitioner, as per FIR, is that on the date of occurrence, i.e., on 20.09.2018 at about 9:00 P.M., a boy of Narayanpur Tola came to informant's house and called his son Izad Ansari and son of the informant went along with him but he did not return. It has further been alleged that about two months back, Rekha Kumari, daughter of the petitioner had developed love affair with Izad Ansari for which family members of Rekha Kumari i.e., petitioner and others confined Izad Ansari in their house and assaulted him and also threatened him to kill within two months.

Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.36529 of 2019(3) dt.30-08-2019 2/2 submits that petitioner has falsely been implicated in this case mere on suspicion and no material has come against him in the entire investigation, except the suspicion raised by the informant and others.

After having heard learned counsel for the parties and taking into consideration the fact that in the FIR as an earlier version, suspicion has been raised against the petitioner and others by the informant and within one day after lodging of the FIR, dead body of the deceased has been recovered by the police, as such I am not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail to the petitioner is hereby rejected.
