28-11-2016 Heard Sri Rama Kant Sharma, learned senior counsel assisted by Sri Rakesh Kumar Sharma, learned counsel for the petitioner and Mr. Md. Fahimuddin, learned Addl. Public Prosecutor.
The petitioner, who is in custody only since the month of May, 2016 in Daudnagar P.S. Case No. 87 of 2016 registered for offence under Sections 3/28(b) (ii) (c)/25/27(A)/29 of Narcotic Drugs & Psychotropic Substances Act, 1985, has prayed for grant of bail. The allegation is that from a car, which was lying near the house of the petitioner, about 164 Kg. of Ganja was recovered. Learned counsel for the petitioner submits that save and except the fact that from car, which was lying near the house of the petitioner, such huge quantity of Ganja was recovered, there
Patna High Court Cr.Misc. No.34772 of 2016 (5) dt.28-11-2016 2/2 is no other material, whereas, learned Addl. Public Prosecutor, after going through the case diary, submits that in the case diary, there is sufficient material against the petitioner. Besides hearing, I have also perused the material on record. I do not find any ground to extend the privilege of bail. The prayer for bail stands rejected.
