JUSTICE RAKESH KUMAR ORAL ORDER 06-10-2016 Heard Sri Pawan Kumar Singh, learned counsel for the petitioner and Sri Ajit Kumar, learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 06.06.2016 in Durgawati P.S. Case No.147/2016 registered for the offence under Section 25(1-b)a/26/35 of the Arms Act, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that the petitioner was a driver of the vehicle Tavera, which was intercepted by the police and from possession of other accused, some arms were recovered. He submits that save and except one mobile, no any other article was recovered from the possession of the petitioner. He submits that besides the present case, on the same day the petitioner was made accused in another

Patna High Court Cr.Misc. No.41021 of 2016 (2) dt.06-10-2016 2/2 case, otherwise the petitioner is having clean antecedent. Keeping in view the nature of accusation and period of custody, let the petitioner, namely, Anuj Kumar be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Durgawati P.S. Case No.147/2016..
