The petitioner seeks bail in a case instituted for the offences under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case in short is that the accused persons killed the son of the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.9.2018 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. This is a case of misuse of privilege of bail. The petitioner was earlier granted bail. Subsequently, for his livelihood, the petitioner had gone outside

Patna High Court CR. MISC. No.44369 of 2019(6) dt.27-09-2019 2/2 the State of Bihar. Due to this, proper pairvi could not be made on his behalf in the Court below and his bail was cancelled. The petitioner undertakes to cooperate during the trial. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri K.K. Mahtha, A.D.J., F.T.C.-I, Banka in connection with S.T. No. 259C/1999, Tr. No. 207/2018 arising out of Dhuraiya P.S. Case No. 61/95.

The lower Court records be sent back to the Court below at the earliest.
