JUSTICE SANJAY PRIYA ORAL ORDER 28-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Section 379 of the Indian Penal Code. It is submitted that the petitioner is not named in the first information report. His name has been disclosed by one Ziyaul Haque in his confessional statement.
Learned APP opposed the prayer for bail of the petitioner.
It appears that during search, some parts of the stolen motorcycle was found in the garage of the petitioner. From perusal of the order of the learned Sessions Judge itself it appears that no T.I.parade of such recovered article was ever done. The petitioner is said to be in custody since 07.05.2016.

No.343 of 2017 (2) dt.28-01-2017 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali P.S.Case No. 124 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
