JUSTICE VIKASH JAIN ORAL ORDER 25-03-2021 Heard learned counsel for the petitioner and learned APP for the State. Learned counsel for the petitioner has filed an undertaking to remove all defects pointed out by the Stamp Reporter as and when required. It is accordingly directed that all defects pointed out by the Stamp Reporter be removed within one month hereof.

2. On 02.03.2021 time was granted to the petitioner to remove the defects. A statement is made at the Bar on behalf of the petitioner that the defects have been removed and a scanned copy of the petition has been filed through online mode on 19.03.2021 and a physical copy would be filed as and when physical filing is permitted by the Court.

3. The petitioner is in custody since 20.06.2020 in connection with Rajgir P.S. Case No. 272 of 2019 (G.R. No. 4043 of 2019) for the alleged offences under Sections 147, 148, 149, 341, 323, 307, 353 of the Indian Penal Code and Section 45(B) of the Bihar Prohibition and Excise Act.

4. It is submitted that the petitioner has been falsely implicated in connection with recovery of 6-7 litres of liquor

The said Suresh Rajbanshi along with Naresh Rajbanshi have been granted bail by this Court in Cr. Misc. No. 7004 of 2020. So also other similarly situated co-accused Bhola Rajbanshi and Jugal Rajbanshi @ Gugal Rajbanshi @ Yugal have been granted bail by this Court in Cr. Misc. No. 7905 of 2020 and Cr. Misc. No. 10927 of 2020 respectively. It is stated that no recovery has been made from the conscious possession of the petitioner. The petitioner claims clean antecedents.

5. Learned APP appears and has been heard.

6. Be that as it may and having regard to the period of custody already suffered since 20.06.2020, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned 3rd Additional District and Sessions Judge-cum-Special Judge (Excise), Nalanda at Biharsharif in connection with Rajgir P.S. Case No. 272 of 2019 (G.R. No. 4043 of 2019), if he is not otherwise required in any other case.

7. Office shall follow-up to ensure that all defects are removed and compliance with the notices of this Court are made by the petitioner within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
