The petitioner seeks bail in connection with Teghra P.S. Case No. 332 of 2022 registered for the offence punishable under Sections 25 (1B) (a), 26 and 35 of the Arms Act. As per prosecution case, the informant along with police personnel raided the house of the co-accused Shailesh Kumar and apprehended the accused persons including the petitioner. Upon search, one folding dagger (chhura), lighter and a mobile phone were recovered from the possession of the petitioner. Several arms were recovered from co-accused persons.

Learned counsel for the petitioner submits that the petitioner is quite innocent and has committed no offence. He

The petitioner has one criminal antecedent and he is languishing in jail custody since 04.12.2022. Charge sheet has already been submitted in this case and there is no chance of absconding or tampering with the evidence. Similarly situated co-accused persons, namely, Sailesh Kumar @ Raja @ Shailesh Kumar and Sunny Kumar @ Sunni Kumar have been granted regular bail vide orders dated 17.05.2023 and 09.05.2023 by a coordinate Bench of this Court in Cr. Misc. No. 18758 of 2023 and Cr. Misc. No. 15656 of 2023 respectively.

Learned APP appearing for the State has opposed the prayer for regular bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I, Begusarai in connection with Teghra P.S. Case No. 332 of 2022.
