The petitioner seeks bail in Jhajha P.S. Case No. 265 of 2016 under Sections 366(A)/34/504 of the Indian Penal Code.

The father of the victim made allegation that the petitioner enticed away his minor daughter. It is submitted by learned counsel for the petitioner that the victim appeared before the Court along with her husband and elder brother-in-law and made her statement under Section 164 Cr.P.C where she stated that nobody kidnapped her and she left her house of her own and solemnized marriage with the petitioner.

Considering the fact that victim herself denied

Patna High Court Cr.Misc. No.14889 of 2017 (2) dt.19-04-2017 2/2 the factum of her kidnapping, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Jamui in connection with Jhajha P.S.
