JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending her arrest in a case instituted under Sections 420, 471, 406, 120(B), 34 of the Indian Penal Code.

There is allegation that the accused persons including the petitioner took an amount of Rs. 23 lacs from the informant in the name of transferring their house in favour of the informant but did not execute the absolute sale deed.For the return of money Shailendra Kumar Pandey and Prabha Pandey issued cheques of Rs. 23 lacs which were bounced twice either due to insufficient fund or closure of the account.

It has been submitted in behalf of the petitioner that the main allegation is against Shailendra Kumar Pandey and

Patna High Court Cr.Misc. No.26661 of 2015 (2) dt.21-07-2015 2/2 Prabha Pandey. So far petitioner is concerned, no specific allegation has been made against her. Further it is also submitted that the petitioner is a lady.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of her arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Patna, in connection with Hawai Adda P.S.Case No. 40 of 2013,subject to the conditions as laid down u/s 438(2) Cr.P.C. (Sudhir Singh, J) singh/- U T
