JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 420 and other minor Sections of the Indian Penal Code. Petitioner and four others were caught and stolen motorcycles were recovered from the place of occurrence. Subsequently, on the basis of disclosure made by aforesaid apprehended persons, several other stolen motorcycles were recovered from different places and, accordingly, several persons were made accused in this case.
Contention on behalf of the petitioner is that petitioner had purchased the seized motorcycle from one Raushan Kumar but unfortunately, he could not get recorded his name in the
Patna High Court Cr.Misc. No.47093 of 2016 (3) dt.08-12-2016 2/2 documents of ownership. It is further submitted that moreover, coaccused Jai Nath Prasad and one other, having more or less similar allegation, have already been granted privilege of bail by different Benches of this Court.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent and is languishing in jail custody since 28.7.2016, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Gopalganj in connection with Barouli P.S. Case No.155 of 2016.
