The petitioner seeks bail in connection with Darauli P.S. Case no. 244 of 2017 registered under Sections 30(a), 38(i), 41(i) of Bihar Prohibition and Excise Act-2016. 267.840 lts. of foreign liquor is said to have been recovered from a Hyundai Car and its driver, namely, Abhimanyu Kumar was apprehended, who disclosed the name of the petitioner and one other person, namely, Prince Kumar as owner of the aforesaid liquor.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has been falsely
Patna High Court Cr.Misc. No.28777 of 2018(4) dt.18-06-2018 2/2 implicated in this case by Abhimanyu Kumar due to animosity. He has no concern either with the seized liquor or with the vehicle in question. He was not apprehended on the spot. Though, four more criminal cases have been lodged against the petitioner, but he is on bail in three cases and acquitted in one of the aforesaid cases. He has been languishing in custody since 20.01.2018.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-2nd, Siwan in connection with Darauli P.S.
