2. The petitioner is named in the F.I.R. and apprehending his arrest in connection with Rupaspur P.S. Case No. 158/2026 registered for the offences punishable under Sections 316(2), 318(4), 319(2), 338, 336(4), 340(2) and 3(5) of the BNS.
3. The allegation against petitioner is to misuse the name of informant for obtaining tender and other related activities by M/s. Esco Switchgears Pvt. Ltd., where petitioner accused is one of the Director.
4. Mr. Ajay Thakur, learned counsel appearing on
Patna High Court CR. MISC. No.40190 of 2026(2) dt.23-06-2026 2/3 behalf of the petitioner submitted that present FIR was lodged on the ground of vague allegation arising out of business rivalry. It is submitted that the documents showing informant as one of the Director, of petitioner's company in year 2022, which is a correct fact. It is submitted that tender as issued by Agra Municipal Corporation was subsequently cancelled. It is further submitted that though the release of payment was withheld by BREDA for sometime in favour of petitioner, but same has no bearing over allegation.
5. Arguing further, it is submitted that with same set of allegation another case was lodged by this petitioner, which has been registered as Rupaspur P.S. Case No. 181/2026, where one of the learned Co-ordinate Bench of this Court granted bail to the petitioner. It is also pointed out that no any complaint ever raised either by private person/BREDA or Agra Municipal Corporation against petitioner. While concluding argument, it is submitted that petitioner is a lady and found involved in 3 more criminal cases, where she is on bail with same informant or the person related with company of informant.
6. Learned APP opposes the prayer of bail.
7. In view of aforesaid factual submission and by taking note of fact as admittedly this petitioner was one of the

No.40190 of 2026(2) dt.23-06-2026 3/3 Director of the petitioner's company, where allegation is clearly based upon suspicion, coupled with the fact as no private complaint as submitted aforesaid was ever raised against this petitioner who is a lady, accordingly petitioner above-named, in the event of her arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-2, Danapur/concerned Court, where the case is pending in connection with Rupaspur P.S. Case No. 158/2026, subject to the conditions as laid down under Section 482(2) of BNSS.
