The petitioner apprehends his arrest in Bhabhua P.S. Case No. 468 of 2014, registered for the offences punishable under Sections 419, 420/34 of the Indian Penal Code and Section 10 of Bihar Conduct of Examination Act.
The petitioner applied for appointment on the post of Constable bearing Roll no. 1019140907, but in his place one Vishnu Deo Kumar was appearing at the examination and he was apprehended on the spot. It was the petitioner who set up Vishnu Deo Kumar who was appearing in the examination for appointment of Constable.
Considering the facts aforesaid, I am not inclined to
Patna High Court Cr.Misc. No.21664 of 2015 (2) dt.07-07-2015 2/2 enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
