In the present case, the petitioner is claiming to be a Mechanic but, from his salary, there is a direction for recovery of the amount of Rs. 44,031/- for the excess consumption of 5108 liter of diesel.

The counter affidavit filed in this case shows that the petitioner was given show-cause and, only thereafter, the action has been taken against him.

At present, this Court is not interfering with the order which has been passed against the petitioner.

Patna High Court CWJC No.8366 of 2009 dt.18-01-2018 Let the petitioner should file an application before the Chief of Administration within a period of three weeks from today who will apply his independent mind and, after hearing the petitioner either personally or through his representative, will pass a reasoned order within a period of eight weeks from the date of filing of the application by the petitioner.

The impugned order will abide by the outcome of the order passed by the Chief of Administration.

With the aforementioned observation and direction, this application is disposed of.
