JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case, initially, registered for the offences punishable under Section 363 of the Indian Penal Code and subsequently, Sections 302/34 of the Indian Penal Code was added.

Petitioner is not named in the first information report but he has been made accused in this case only on the ground that in course of investigation spy of the police disclosed that some days prior to the alleged occurrence, a quarrel had taken place between deceased and petitioner as well as one co-accused, Rahul. It appears that except the aforesaid material, there is nothing against the petitioner, who is languishing in jail custody since

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Rosera, Samastipur in connection with Hasanpur P.S.
