JUSTICE BIRENDRA KUMAR ORAL ORDER 22-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is languishing in custody in Barachatti P.S. Case No.401/16 for the offences punishable under Sections 272, 273, 120(B) of I.P.C. and Sections 30(a), 38, 47 of the Bihar Excise Act, 2016.

From a vehicle foreign liquor as well as country made liquor was recovered.

The petitioner submits that he was simply a passenger in that car and had no knowledge about the liquor. He is a student having no criminal antecedent. He is in custody since 8.10.2016.

Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing

Patna High Court Cr.Misc. No.52470 of 2016 (3) dt.22-12-2016 2/2 bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the A.C.J.M., Sherghati,Gaya, in Barachatti P.S. Case No.401/16.
