ANJANA PRAKASH ORAL ORDER 2/ 28-05-2015 Learned counsel for the Petitioners seeks permission to withdraw this application for anticipatory bail in so far as it relates to Petitioner No.1-Ravindra Giri.

The application is dismissed as withdrawn in so far as Petitioner No.1-Ravindra Giri is concerned. Heard learned counsel for rest of the Petitioners and the State.

The Petitioner Nos.2 and 3 apprehend their arrest in a case instituted for the offence under Section(s) 302, 201, 307/34 Indian Penal Code.

Considering that since there is no specific allegation against the Petitioner Nos.2 and 3, who have fair antecedents, and the only allegation against them is under Section 201 Indian Penal

Patna High Court Cr.Misc. No.18227 of 2015 (2) dt.28-05-2015 2/3 Code which is bailable, it is ordered that in the event of surrender/arrest of the Petitioner Nos.2 and 3 i.e. Rupak Giri and Deepak Giri, within four weeks from the date of receipt/production of a copy of this order in connection with Ekma P.S. Case No.162 of 2014, they shall be released on anticipatory bail on furnishing bail bond of `5,000/- (five thousand) each with two sureties of the like amount each or any other surety to be fixed by the court below to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra, subject to the conditions as laid down under Section 438(2) Cr. P. C. and (i) That one of the bailors will be a close relative of the Petitioners, who will give an affidavit giving genealogy as to how he is related with the Petitioners.
