Heard learned counsel for the parties.

This application for regular bail arises out of Excise Case No. 269 of 2020 (Trial No. 112 of 2021), registered for the offence punishable under Sections 30(a), 30(d), 36, 38 and 41(1) of the Bihar Prohibition and Excise Act, 2018. There are six persons named in the F.I.R., who were arrested by the Police consequent upon recovery of 1200 litres of spirit loaded in a truck, 1800 litres loaded in a pick-up van, 600 litres from another pick-up van and 5200 litres from the godown. The petitioner was the driver of the truck from which recovery of 1200 litres of spirit was made by the excise

Patna High Court CR. MISC. No.49885 of 2021(2) dt.08-09-2021 2/2 officials. The petitioner is in custody since 20.08.2020. It has been stated in the application that the petitioner has no criminal antecedent.

Learned counsel for the petitioner has submitted that all other co-accused persons have been allowed regular bail by this Court by different orders.

Considering the aforesaid submission and the petitioner is in custody since 20.08.2020, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned 2nd Additional Sessions Judge-cum- Special Judge, Excise, East Champaran at Motihari, in Excise Case No. 269 of 2020 (Trial No.112 of 2021).

This is subject to the condition that the petitioner shall present himself before the Police / Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bond shall be liable to be cancelled.
