JUSTICE BIRENDRA KUMAR ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 147/ 149/ 342 /343 /448 /379 /506/ 504 /457/380 of the Indian Penal Code.

The accusation of entering into the house of the informant variously armed is against thirteen F.I.R. named accused persons including the petitioner. Further allegation is of commission of loot and damage.

Submission is that nothing has been recovered from the possession of the petitioner and similarly situated coaccused Shambhu Sah has been allowed bail by a coordinate Bench in Cr. Misc. No. 9168 of 2016 and co-accused Nageshwar Singh has been allowed bail in Cr. Misc. No.7102 of 2017.

No.10366 of 2017 (2) dt.18-03-2017 2/2 Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sikarana at Dhaka, East Champaran/Successor Court, in connection with Ghorasahan (Lakhaura) P.S. Case No.263 of 2014.
